AGREEMENT made and entered into on the
______ day of _________, 2005, by and
between AuctionStore.comTM, having its
principal place of business at 39 Stringham Avenue,
Valley Stream, NY 11580,
hereinafter referred to as the “Store” and

having its
principal place of business at
____________________________________________________________________
hereinafter
referred to as the “Charity”.
The parties
agree as follows:

The “Store”
is granted the right and privilege to
auction donated items on eBay® on behalf
of the "Charity".

The “Store”
will strive to gain the highest value
possible for the goods listed.

The “Store”
will maintain the utmost integrity with
respect to our relationship with the
"Charity" as well as the donor. We shall
endeavor to minimize any expenses which
may be necessary to maximize the potential
value of the goods donated (i.e. cleaning,
sewing, repair, etc.). Said expenses (if
any) are deducted from auction proceeds.

The “Store”
will handle all aspects of the online
auction with eBay® which will include
but
are not limited to the following:
a.
We receive your donated merchandise.
b.
We sort, inspect, clean and
professionally photograph your items.
c.
We secure your goods in our climate
controlled facility during the sale when
necessary.
d.
We prepare compelling descriptions
for each of your items and launch them on
eBay®. Charities can view their items
online at AuctionStore.com’sTM website.
e.
We carefully monitor all aspects of
your auction and respond to inquiries from
potential buyers by telephone or email.
f. We
secure payment for your goods following the
auction.
g.
We pack and ship all of your items
that sell to their respective buyers.
h.
We advance all eBay® listings, final
value and electronic processing fees.
i.
Proceeds settlement checks will
be sent to charity.

The
"Charity" has no financial obligation
whatsoever.

Our fees
for our services are on a sliding scale of
10% to 39% depending on the final amount
each item brings at auction… our fee
schedule is listed below:

10% of
the portion of the auction selling price
above $5000.01 |
|
25% of
the portion of the auction selling price
between $500.01 - $5000 |
|
39% of
the portion of the first $500 of the
auction selling price.
|

Additionally there is a 10% pick up
surcharge (to cover our added expenses)
for those items that are not delivered
to our location and we must pick up.
eBay’s listing, final value and any
electronic payment processing fees that
we advanced to eBay for the auction are
subtracted from the “Charity” share of
the proceeds disbursement

The “Store”
will comply with all the laws, ordinances,
rules and regulations pertaining to the
operation of the Auction, and the
"Charity" will be held harmless against
any fine, penalty or damage for any actual
or alleged failure on the part of The
"Store" to comply therewith.
